1. Acceptance of these Terms

By downloading or using skintone.uv ("the App"), you agree to these Terms of Use. If you don't agree, please don't use the App.

2. The Service

skintone.uv provides personalized sun-protection guidance: skin tone classification using the Monk Skin Tone Scale, real-time UV index data, recommended SPF, reapply timing, tanning windows, and related features. The App runs on iOS and is operated by Stefan Hurzlmeier (see Imprint).

3. Not medical advice

skintone.uv is a wellness and lifestyle tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. SPF recommendations and UV alerts are guidance only. Always consult a qualified healthcare professional for any concern about your skin, sun exposure, or related health questions. Do not rely on the App as a substitute for professional judgment.

4. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with the consent of a parent or legal guardian.

5. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your private, non-commercial use, subject to these Terms and to Apple's standard end-user license agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/).

6. Subscriptions and billing

Some features require a paid subscription. Subscriptions are sold through your Apple ID and managed by Apple. • A free trial may be offered. If you do not cancel before the trial ends, your subscription auto-renews at the price displayed in the App Store at the time of purchase. • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. • Manage or cancel your subscription in App Store → your Apple ID → Subscriptions. • Removing the App does not cancel an active subscription. • Prices and offers may vary by region and may change over time.

7. Refunds

Purchases on the App Store are processed and refunded by Apple, not by us. To request a refund, use https://reportaproblem.apple.com/. Local consumer protection rights (including, where applicable, the EU 14-day right of withdrawal) are not affected; please note that by starting to use a digital subscription you may waive that right of withdrawal under EU law.

8. Acceptable use

Don't reverse-engineer, copy, redistribute, or commercially exploit the App, except where applicable law permits this. Don't use the App to harass others, infringe rights, or violate any law.

9. Intellectual property

The App, including its design, code, and content, is owned by Stefan Hurzlmeier or its licensors and is protected by copyright and other laws. The Monk Skin Tone Scale is referenced under fair use; trademarks belong to their respective owners.

10. Disclaimer and limitation of liability

The App is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or skin damage, arising out of your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. liability for intent or gross negligence under German law).

11. Changes

We may update these Terms from time to time. The current version is always available at https://skintoneuv.app/terms/. Material changes will be communicated in-app or by email where appropriate.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. Mandatory consumer protection laws of your country of residence remain unaffected. Place of jurisdiction, where legally permissible, is Regensburg, Germany.
